01 — About

ByeBed (hereinafter "the Service", "the App") is operated by Louis Hubert Cottineau (TIN: 302340116), a sole proprietor based in Georgia.

By downloading, installing or using this Service, you agree to be bound by these Terms and Conditions.

02 — Service Description

ByeBed is a mobile alarm clock application for iOS that requires the user to complete a mission (such as math problems, shaking the phone, push-ups detected by the camera, photographing a random object, and others) in order to dismiss the alarm. The purpose is to make it harder to go back to sleep.

ByeBed runs primarily offline on your device. A limited server component is used only for certain missions that require external processing, such as the Photo mission (see Privacy Policy).

03 — Terms of Use

You must be at least 13 years old to use this Service.
You are responsible for configuring your alarms correctly and for verifying that they work as expected on your device.
You must not use the Service for illegal or harmful purposes.
You must not modify, reverse engineer, decompile or otherwise attempt to extract the source code of the App, except to the extent expressly permitted by applicable law.
You must not redistribute, resell or sublicense the App outside of the App Store.

04 — No Warranty on Alarms

Alarms are scheduled through Apple's AlarmKit and/or the iOS notification system. ByeBed relies on these system services to trigger at the scheduled time.

We make no guarantee that a given alarm will ring exactly at the expected time in all circumstances, including but not limited to: device powered off, low battery, Do Not Disturb misconfiguration, iOS system issues, scheduling quotas, or permissions revoked by the user.

⚠️ You are solely responsible for any consequence of an alarm not ringing. For time-critical events, you should use additional, independent alarm sources.

05 — User Content

ByeBed does not host public user content. Any data you enter in the app (alarm labels, settings, statistics) is stored locally on your device. Photos taken during missions that require image recognition (such as the Photo mission) are sent to our processing provider for recognition only and are not stored (see Privacy Policy).

06 — Premium Subscription

ByeBed offers a paid Premium subscription that unlocks additional features. The current feature list, pricing and billing cycle are displayed in the App before any purchase.

Premium subscriptions are sold and billed exclusively through the App Store. Apple Inc. is the merchant of record for all in-app purchases and subscriptions made through ByeBed on iOS.

Subscriptions renew automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time from your Apple ID → Subscriptions.
Cancelling stops future renewals; you keep Premium access until the end of the paid period.
No refund is given for the unused portion of a current period.

Refund requests are handled by Apple and subject to Apple's refund policy: support.apple.com/en-us/HT204084

Premium features may evolve. We will not remove a substantial feature from your active subscription without notice.

Prices displayed in the App are VAT-inclusive where applicable. Prices may vary by region and are set by Apple based on local tiers.

07 — Free Trial (if offered)

If a free trial is advertised, it is granted once per Apple ID. Any unused portion of the trial is forfeited if you purchase a subscription before the trial ends. Auto-renewal into a paid plan happens at the end of the trial unless you cancel at least 24 hours before.

08 — Termination

We reserve the right to suspend access to the Service or remove the App from distribution at any time, in particular if you violate these Terms.

You may stop using the Service at any time by uninstalling the App, which immediately and permanently deletes all locally stored data. Uninstalling does not cancel an active subscription — to cancel, go to your Apple ID → Subscriptions.

09 — Limitation of Liability

The Service is provided "as is" and "as available", without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for missed appointments, lost profits, loss of data, or loss of opportunity resulting from the use of, or inability to use, the Service.

10 — Modifications

We reserve the right to modify these Terms at any time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Service after such changes constitutes acceptance of the new Terms.

11 — Governing Law

These Terms are governed by the laws of Georgia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Tbilisi, Georgia.
